What are commercial service charge disputes?
Commercial service charge disputes cover any dispute which involves the legality of a service charge demand.
This includes whether a demand is payable in respect of the way in which it has been calculated and/or apportioned to the commercial tenant, or relates to service charge arrears which are due from the commercial tenant.
Commercial service charge disputes are distinct from residential service charge disputes, as the onerous statutory obligations which are implied in residential leases do not apply.
It is; however, important to understand the unique drafting of the commercial lease which stipulates the service charge obligations, as the wording can greatly impact upon a landlord’s options for recovery and enforcement.
