What is a Party Wall Act dispute?
A party wall is a building or wall which divides and is shared by two properties. It could be the dividing wall in a terraced or semi-detached house or a wall or structure on the boundary of which both sides have equal ownership.
The Party Wall Act 1996 provides a framework for preventing or resolving disputes in relation to building works to be carried out to party or boundary walls, and structures. It also covers excavations close to neighbouring buildings.
An owner intending to carry out works must give the adjoining owner notice of their intended works. The adjoining owner is given the opportunity to object or require additional works. If agreement cannot be reached then the Act prescribes a mechanism to resolve the dispute which will culminate in a Party Wall Award.
