What is a separation agreement?
A Separation Agreement is a legal contract between separating couples which regulates the terms on which they will live apart from one another. The agreement will govern various financial issues such as what should happen to the family home, the rate and term of any financial support and numerous other matters. It will also confirm the circumstances and basis upon which they will divorce in the future.
These agreements are usually entered into where separating couples wish to live apart from one another but either do not wish to divorce at all (such as for religious reasons) or simply do not wish to divorce for the time being, such as because they wish to leave the door open for a potential reconciliation in the future.
A Separation Agreement represents the only way to regulate the financial aspects of a separation outside of divorce or civil partnership dissolution proceedings. It is not possible to obtain a Financial Consent Order without either party commencing divorce or dissolution proceedings. They can be converted into a Financial Consent Order in any subsequent divorce or dissolution proceedings.
