How much can I get for a discrimination claim? Updated guidelines on injury to feelings awards

From tomorrow, 6 April 2019, the bands that the employment tribunal take into account as guidance when awarding compensation for injury to feelings in discrimination claims increases. These are known as Vento bands.

Injury to feelings make up part of the compensatory award in successful discrimination cases and, in short, are calculated based on how serious the discriminatory conduct was and the effect that it has had on the Claimant. Other aspects of the tribunal awards are loss of earnings, pension and other benefits.

The bands for claims presented on or after 6 April 2019 will be as follows:

  • Lower: isolated/one-off occurrence (£900 to £8,800).
  • Middle: serious cases that do not merit an award in the upper band (£8,800 to £26,300).
  • Upper: most serious i.e. lengthy campaign of discrimination (£26,300 to £44,000).
