A legal separation agreement is a contract between you and your spouse in which you agree to live apart from each other. The agreement can also deal with other issues which arise upon separation, such as an agreement for one party to pay the other maintenance, arrangements in respect of the family home and arrangements for the children.
It is not possible to obtain a Court Order setting out the terms of a final settlement and dismissing outstanding financial claims until the stage of Decree Nisi is reached (or a Conditional Order in the dissolution of a Civil Partnership). Therefore, should you wish to formalise the financial aspects of your separation between you and your spouse before starting divorce proceedings, then you may want to consider entering into a Separation Agreement.
