Unless you have an express right to enter a neighbour’s land or the neighbour provides consent you will commit a trespass by entering their land.
This is the case even if you require such access to undertake essential works which are not possible without entering the neighbouring land. Should you proceed without such consent, or without obtaining an appropriate court order your neighbour can seek an injunction order prohibiting you from entering their land.
Access Disputes and Injunctions Specialists
Breach of an injunction has very serious consequences and could lead to a term of imprisonment. Whether you require access or want to oppose such a request it is essential that you are properly advised to protect your position.
Our specialist team can assist by advising as to your rights if you wish to gain access to a neighbour’s land for essential work or wish to oppose such request. If matters can be agreed between the parties we can draft an access agreement. If this is not possible we can act in bringing or defending proceedings including injunctive action.
