The process of terminating a residential tenancy is notoriously complex and challenging, even for the most experienced landlords. It is important to ensure that the correct procedure is carried out, as failure to do so can result in both civil and criminal sanctions. Applying the incorrect procedure can further result in significant delay and lead to loss of rental income, which may be difficult to recover against a tenant with insufficient means of repayment.

The law in this area is heavily weighted in favour of the tenant, notwithstanding possible breaches of tenancy and ever-mounting rent arrears. In certain circumstances, it is possible to circumvent lengthy legal proceedings by utilising the accelerated possession procedure; however, this will not apply to disputed cases.
