What is an adverse possession claim dispute?
A claim for adverse possession is a claim against the person who legally owns the land by someone who has used it for at least 10 years (if the land is registered) or 12 years (if the land is unregistered).
The person claiming has to show that they have been using the land without permission from the legal owner. They also have to show that they intentionally possessed the land.
They will need to prove both factual possession and also an intention to possess the land. A Land Registry application can be submitted to register ownership. The Land Registry will notify the legal owner who has the chance to object to the registration.
