What is trespass and nuisance dispute?
Trespass is a form of nuisance. Trespass relates to the direct and physical interference with land whilst a nuisance claim is more indirect such as interference by smells or noise. It is a trespass to unlawfully occupy or access another’s land.
It doesn’t have to be interference by a person. It can be erecting a wall or fence in the wrong place, putting in drainage or placing items on neighbouring land. Nuisance is using property in a way which affects adjoining land. Examples would be smells, noise, or encroaching tree roots.
