What is a right to light dispute?
A Right to Light is a legal right for the benefit of one property over another property. It gives a property owner the right to a certain amount of light to windows or openings in a building. It can be contained in a deed but generally arises if a property has benefitted a certain amount of light and has done so for 20 years or more.
Disputes can arise when a new structure on neighbouring land reduces the amount of daylight enjoyed, particularly when daylight is blocked in key areas such as gardens.
