What is a cycling accident?
Cycling accidents cause injury to the rider and damage to the bike, with cycling traffic on the roads increasing year on year in the UK so does the level of cycling accidents, these are accidents which can involve motor vehicles, other cyclists, pedestrians or uneven road surfaces.
If you are injured in a cycling accident it can be a life-changing experience, but if it wasn’t your fault you will be able to claim for the compensation to which you are entitled.
Here are just some of the steps you can take after an accident which may help when making a claim:
1. Get out of danger.
If it is safe for you to move, try to make sure you and your bike are clear of the road/any further danger.
2. Gather Evidence.
Take down details of the other vehicle and rider involved plus any witness details. Try to take photographs of the accident scene and the positioning of the vehicle in the road and locate any cctv (this my be obtainable from the council). If you are wearing a cycle camera on your helmet at the time of the accident the footage will be admissible in court.
3. Keep damaged property.
You can claim the cost of replacing/repairing the damaged items, holding on to the items can help to evidence the value and level of damage.
4. Seek medical assistance.
It is always advisable to get checked over by a medical professional if you are involved in an accident, even if your injuries appear to be minor. The quicker you get checked over the faster any injuries can be treated. This can lead to a shorter recovery period meaning you will be able to get back on your bike sooner rather than later!
5. Keep a list of expenses.
You may be able to claim back expenses such as travel to and from medical appointments, physiotherapy sessions and time off work.
6. Get advice before accepting an early settlement offer.
You may receive an early settlement offer from the other party’s insurers before you realise the full extent of your injuries. It is always recommended that you seek independent legal advice before accepting a settlement offer.
How to report a cycling accident?
If you are involved in a cycling accident causing damage or injury to a person, motor vehicle, property or an animal it is always advisable stop and provide the other party with your name and address and likewise obtain the other parties details, if a motor vehicle is involved, try to get the vehicle registration and the insurers details.
These details will be necessary later down the line should you need to make a claim, we can use the other parties vehicle registration to get in touch with their insurers. You may not be aware at the time of the accident of the full extent of your injuries so it is important to obtain as much information as you can at the time in case you need it further down the line.
If for any reason you do not exchange details you should always report the accident to the police within 24 hours and obtain a reference number. If you don’t exchange details at the scene, or report the incident to the police, it could result in one of two offences; failure to stop and failure to report an accident.
