Domestic Violence
Domestic Violence can take many different forms and is not just physical violence. The government defines domestic violence and abuse as:
“Any incident or pattern of incidents of controlling, coercive or threatening behaviour, violence or abuse … regardless of gender or sexuality. This can encompass but is not limited to the following types of abuse: psychological, physical, sexual, financial and emotional”.
Our domestic violence solicitors offer a sensitive and discrete service. We will advise you as to both the legal and practical steps that can be taken to protect you and your family.
If necessary, our solicitors will act quickly where there has been an allegation of Domestic Violence and we regularly represent clients in applying for (and defending) the following urgent applications:
Occupation Orders – These usually regulate the occupation of the family home. They can be used to exclude a person from a property and the surrounding area or enforce a person’s right to remain in a property. They can also divide up a property so that you are not in the same space at the same time.
Non-Molestation Orders – These prohibit a person from using or threatening to use violence as well as from using intimidating or harassing behaviour. They can also prohibit a person from encouraging another to behave in that manner.
Our focus in any situation involving Domestic Violence is first and foremost to ensure the safety of those concerned but also to focus on the longer terms implications for both parties. This necessitates a constructive, no nonsense approach to avoid further raising the temperate and creating a greater risk for all those concerned.
